Farm businesses are fundamental to New York’s economy and the agricultural food and product diversity that the state is renowned for. Yet, farms across New York are struggling to stay in business. Chapter 12 is designed to support “family farmers” and “family fisherman” in restructuring their finances to avoid liquidation or foreclosure. This program is meant to help farmers, and the lawyers that serve them, understand the rights and protections afforded under Chapter 12 of the United States Bankruptcy Code. We are fortunate to have a Federal Bankruptcy Judge present this program, along with a standing Chapter 12 and 13 Trustee, a Chapter 12 debtor’s attorney, and a creditor’s attorney. The panel will discuss a hypothetical Chapter 12 case and highlight certain aspects from pre-filing planning through discharge. 2 CLE credits available for attorneys. Everyone welcome.
